NELHUAYOTL REALTY COVENANT AND ZONING RULES

This Covenant is an agreement between Nelhuayotl Realty and its Residents. It serves as a guideline for the relationship between Nelhuayotl Realty and Residents and as a guideline for Resident land usage on Nelhuayotl Realty owned sims.

LAND TIER

Parcel purchase represents the payment of a non-refundable purchase of usage rights. These rights grant the transferable right to use the parcel as long as the rights holder makes tier payments when due and the region is maintained by Nelhuayotl Realty. The first tier payment is due immediately and will be reclaimed within 24 hours if no immediate payment is made. After the first payments have been made, parcels with tier fees 3 days past due will be reclaimed with no refund. Purchased land may not be resold until tier fees are paid. Nelhuayotl Realty reserves the right to reclaim land to prevent such a sale or, if the land is sold, ban that Resident or immediately repossess future purchases until the full balance due is recovered.

Residents of Nelhuayotl Realty agree to pay a monthly tier fee for land usage. First payment is due immediately after a parcel is purchased as outlined above. The first payment must be for a minimum of 4 weeks. Recurring payments can be for 1 – 12 weeks. Tier payments via Lindens are made through the board at the sim’s Welcome Center. It is the Resident’s responsibility to make sure payment is made on time.

DO NOT RETURN EXISTING OBJECTS ON ISLANDS UNTIL TIER IS PAID.

Normally, Nelhuayotl Realty will reclaim all parcels that fall 3 days into arrears. If a Resident contacts us before the 3rd day and has a deposit on reserve an extension for one week only. Only one extension will be granted each month and payment will be applied to outstanding balance.

Tier is charged according to our rate table, located at the end of this Covenant. Nelhuayotl Realty will only force a rate increase for existing residents in the event Linden Labs increases the tier rate Nelhuayotl Realty pays. This rate increase would take effect with the next tier payment.

If you have unused tier from Linden Lab you can NOT use it in Nelhuayotl Realty. Vice versa you can NOT use Nelhuayotl Realty tier in mainland sims. Nelhuayotl Realty properties are privately operated and tier fees paid to Linden Labs are not in effect in Nelhuayotl Realty.

Tier Payments and Land Purchase Prices are NON-REFUNDABLE.

NO RED TAPE – NO BAN LINES

Nelhuayotl Realty does not and will not allow red tape, green tape or any security device that hinders any avatar’s free movement across the sim. Residence in our sims is based on common sense practices. We strive to provide you with a fun, safe and pleasant environment that you are happy to call your own.

Security orbs may be used, but only if the following rules are observed. If Residents do not comply and follow these rules exactly, Nelhuayotl Realty will return the orb once a complaint is received. The second time a complaint is received for non-compliance, everything will be returned and the parcel resold for violation of the covenant.

Below are the requirements that MUST be met in order for Nelhuayotl Realty Residents to place security orbs.

1) You MUST add all of the neighbors on your sim to your orb and mark them as safe.

2) You MUST add your neighbor’s friends or partners to your orb if they request that you do so. It is not acceptable to have the guest of any resident booted for visiting a friend.

3) You MUST be courteous and polite when you request that your neighbor add your guest(s) to their orb.

4) You MUST be courteous and polite when you are requested to add your neighbors’ guest(s) to your orb.

5) You MUST also add Alida Tomsen and any Estate Managers to your orb. Residents will be updated when Estate Managers come into or leave Nelhuayotl Realty.

6) The range of your orb must be kept low. No greater than 20 meters. I sell this land and if I have people looking at the land to buy and they get booted before they can examine the land, read the covenant and make their decision, I will be none too pleased about it.

Everyone wants peace and quiet and a nice view. Your neighbors are highly unlikely to bother you and in many cases you are probably happy to welcome them into your home if they respect your home and your times of privacy. It is with this logic in mind that you are required to add your neighbors to your safelist. If for some reason you have a dispute with your neighbor, contact Nelhuayotl Realty staff and we will have to work to a solution. Please message Alida Tomsen should any such issues arise.

Land sold in Nelhuayotl Realty sims provide a nice, pleasant experience. This includes being able to fly across the sim without running into walls. Only one warning will be given. Replacing banlines after the first warning will result in the land being reclaimed by Nelhuayotl Realty with no refund given. If someone persists in annoying or harrasing any Resident, message Nelhuayotl Realty staff and the offending party will be banned from every region owned by Nelhuayotl Realty.

Nelhuayotl Realty understands that there may be times when someone intrudes upon your land and our staff stands ready to ban any individual from the sim that wishes to harass our residents. We ARE your security barrier and we WILL react and ask questions later to protect the Residents of our sims.Nelhuayotl Realty reserves the right to refuse service to anyone.

RESIDENTIAL ZONING (commercial zoning listed below)

A residential sim is a place where residents can build a home, invite friends over for parties and conversation and have a peaceful and enjoyable time. If you have a small business that you might operate out of your home in a real world circumstance, it is reasonably safe to assume that we will allow this here as well.

Examples might be:
A photography business.
A consulting service.
A makeover service.

In general any small business where you. the landowner MUST be present in order for the service to be provided and where low traffic can be expected. This does not mean that you can set up a photo gallery of prints for sale or sell shapes and skins in your home under the guise of a makeover service. If any home business violates the spirit of this covenant, Residents will be given a warning. As with ban-lines, the second warning will result in land being reclaimed without any refund.

RENTALS
Residents may purchase parcels within Nelhuayotl Realty and rent them. We ask that rental signs not be unsightly or a blight on the landscape; no large spinning or airborne signs. We do of course want you to find success in renting your land but the rules of Nelhuayotl Realty are still in effect and landlords are responsible for letting their tenants know the rules.

RESELLING PARCELS
Residents may not slice their land into unusual shapes or parcel sizes for resale. Land set for resale must be set at the original parcel purchase size. (If you purchased a 4096 sqm parcel, you may only resell it in the same fashion.)

BUILDING CODES

o No malls.
o No clubs.
o No casinos.
o No sandboxes.
o No flying structures below 300m altitude.
o No obstructive signs or rotating objects.
o No high-rise structures. No castles, towers or medieval structures in a non-forested sim. These builds tend to loom ominously and are out of place in most tropical settings.
o Maximum building height is 2 times the distance of the building from the parcel border.
o Buildings must have adequate distance from parcel borders
o No “crazy wacko” builds. Sim management reserves the right to judge what a “crazy wacko” build is and they will ask that it be removed.
o Terraforming is allowed but use good common sense. If the sim has been nicely terraformed with rolling hills you may level an area to place your home but please do not flatten the entire area. Preserve the landscape as much as possible.

MAXIMUM BUILDING HEIGHT

Maximum building height is 2 times the distance from the parcel border. This rule insures that your neighbors do not feel crowded by a looming build or must look out their window at a wall or other object that is obstructing their view.

OBJECTS AND SCRIPTS

o No spy scripts > Run a spy script in a Nelhuayotl Realty sim and get banned forever. PERIOD.
o No shout objects.
o No vendors.
o No scripts that transmit data directly or indirectly to external databases.
o No high lag scripts.
o No scripts or add on applications that duplicate geometry or textures that you do not own. Nelhuayotl Realty will not tolerate any infraction upon the intellectual rights of others and will take legal action to pursue and apprehend any such perpetrator in violation of the Digital Millennium Copyright Act (DMCA).

EXCEPTIONS

Exceptions to some of these rules may be allowed if residents in a sim unanimously agree and those changes don’t affect the experience in neighboring sims.

RULES OF CONDUCT

o No harassment or stalking.
o No sexual harassment.
o No nonconsensual player vs. player combat.
o Do NOT build on land that does not belong to you.
o No entering other people’s homes or personal space without being invited.
o No public nudity. Though Nelhuayotl Realty sells only mature parcels, keep nudity within the confines of your home.

THEMED SIMS

Some sims have a special theme. This can be an architectural theme, cultural theme or a language theme. We will provide specific rule sets for these themed sims when they are set up.

NELHUAYOTL REALTY LIABILITY

Land is provided as is to residents. We will work diligently to enforce rules governing lag scripts and objects and intrusions upon your privacy. However we can not guarantee performance or frame rates as connectivity issues, driver issues and the quality of individual residents computer systems may vary.

Nelhuayotl Realty reserves the right to amend or append these zoning rules at any time to protect its residents and provide an optimum experience in their best interests.

TIER FEE (effective 02/20/09)

4096 sq. m: L$ 1975 per week

Residents will have the ability to reserve, at no charge, the club house for private events, by previous arrangement with Alida Tomsen or other Nelhuayotl Realty staff. All others may rent the club house by prior agreement.
